The Flexibility Deficit

India's legacy labor laws are highly protective of workmen. Under the Industrial Disputes Act (IDA), manufacturing firms with over 300 employees (in most states) require government permission to lay off workers or shut down—permission which is rarely granted.

The New Labor Codes

Parliament has passed 4 new Labor Codes to consolidate 29 central laws, aiming to increase the threshold for layoff approvals and standardize definitions. However, implementation is delayed as labor is a 'Concurrent List' subject, requiring state governments to frame rules.

White Collar vs Blue Collar

Labor laws predominantly apply to "workmen" (blue-collar, non-supervisory roles). White-collar (managerial) employees are governed largely by their employment contracts and state-specific Shops and Establishments Acts, offering much higher flexibility for tech and services firms.
